JUDICIAL INTERVENTION IN THE CHEMICAL UNITY
OF CUBATÃO / BRAZIL – RHODIA
On 5 February 1993, a denunciation to the Public Ministry have indicated that inside the Rhodia's chemical unit existed a digging ditch containing polluting material.
It was checked
that the concerning place presents incompatible contamination degree
to human life and liable to promote severe damages to the environment,
particularly to the water resources (water table).
In fact the found digging was used as a deposit of highly toxic materials, the industrial solid residues - ISR, generated at the unit's production process.
As we saw, the ISR are compound of highly dangerous chemical products being the main one the Hexachlorobenzene, besides the Hexachlorobutadiene, Pentachlorobenzene and tetrachlorobenzene among others, being this substances world-wide disapproved due to its highly harmfulness to the environmental medium, causer for the numberless diseases to the health and living creature, among then the cancer and severe poisoning events.

Concerning
to the cancer prevention, the specialised international bibliography
warns on severe danger caused by Hexachlorobenzene and Hexachlorobutadiene
by issuing manuals with the purpose in giving subsidies for its adequate
handling, sponsored by entities of high world-wide respectability.
It is causing serious preoccupation the high concentration of ISR badly disposed at the site, that is infinitely higher to the limits accepted internationally for the environmental medium.
Thence
to affirm that there is absolute incompatibility to the human life.
To
give an idea on the international parameters that are not standards,
but recommendations (face to the incontables uses given to each soil),
there are countries as Germany, not so exacting, that accepts a limit
of 50.0 ppb (parts per billion) for the Hexachlorobenzene at gardens
and recreation areas. Swiss, most exacting, accepts 10.0 ppb, not
allowing the use at planting, pasture and recreation area.
Concerning to the ISR found inside Rhodia, in the taken soil portion, it was checked that the Hexachlorobenzene, compared to the Germany's recommendations, was 15.340 times greater than the 50.0 ppb of German standard.
As we saw, the toxin products concentration levels inside the Rhodia reaches critical levels. It must be emphasised the highly reprehensible behaviour of the RHÔNE-POULENC 's filial, since it have been hiding from all the society by several years the existence of this guilty fact, in detriment of the individual's life quality for the individuals that have been in contact to that hostile environment.

And, to raise the question seriousness there are a numberless of public lawsuits and judicial actions against Rhodia. Including an action under number 275/92 that forces RHODIA to prospect all area searching for clandestine storage of organoclorados products of its responsibility.
Even in that action RHODIA has hidden the contamination at its own Chemical Unit in Cubatao.
RHODIA
has hidden this fact due the consumption of large sum of money that
it would be forced to spend for adequate solution of the problem,
besides having its image implicated in the presence of the public
purse.
The problem seriousness, where it is seen the absolute impossibility to the existence of human life in this location, it is pointed by the fact that all RHODIA's employees are contaminated by Hexachlorobenzene, including the death of workers hitherto, just after the interdiction.
On 7 July 1993, the Cubatao's justice have determined the quick and total interdiction of Rhodia's Chemical Unit in Cubatao.
Today the unit is still interdicted, after almost eight years.
